Al-Tabarany narrated that the Prophet [PPBUH] said: (Shari'a came on 360 way). So no should argue with objection to anyone else unless he can consider his opponent's way and find out that it does not agree with any of the 360 ways. Shari'a did not say that except to close the door to arguing without knowledge. This is to enforce the religion, as disputing makes it weak. Sayydi al-Khawas [AAH] said: "the religion is set only with consensus, not with disagreeing. Then it is nor right for the scholars to agree unless they get out of the slavery of their self desires, and if they do not get out of it, it will never be right for them to connect their hearts with one another".
The Prophet [PPBUH] said: (No people have been strayed after been rightly guided, unless they have taken arguing), then He recited: [This they set forth to you, only by way of disputation: nay, they are a contentious people] Az-Zukhruf 43:58, narrated by al-Baihaqy, al-Turmuzy, and others. Also He [PPBUH] said: (the most detestable of the men, to Allah, is the fierce disputer), narrated by al-Bokhary, Muslim, and others. In this Hadith the fierce means: the one who is vehement with the argue, and the disputer here is: he who refutes the evidance of his opponent. Of cource this does not enclude those who came with something that is not in accordance with the book of Allah, the Sunna of the Prophet, or the great companions & followers, as refuting the claimed evidance of those would be supporting for Allah, his Messenger, and Muslims; and Allah is the All-Merciful, the All-Forgiver. So we do not argue in any of the Legal scholar [Shari'a] knowledge unless it is for the support of the religion and on the condition of purity and with witnessing Allah's presence as with insight not with supposition, hypocrisy, heedlessness, guesswork, or just contending the opponents of some other doctrine.
Also it should be known that a follower of some Imam or doctrine cannot call someone of another doctrine as adversary, because the use of the polite words is a virtue of the scholars. The writer of the book "the Mohammadian covenants" said that someone showed him a book of refutation of Imam Abo-Hanifa. That night he saw, in a vision, Imam Abo-Hanifa have become as tall as seventy meters in the sky and the man who did him wrong was like a small black mosquito.
If Imam ash-Shafi'y
says: "When it comes to Fiqh, all people are little boys", then how
can the likes of us confront him or his opinions? This would be a
very high level of madness. Allah Almighty said: [He
has legislated
for you that same religion as that which He
commended unto Noah, the which We inspire
in you, and that
which We commended unto Abraham, Moses, and Jesus:
Establish the religion
upright, and make no divisions therein]
ash-Shura 42:13,
so Allah ordered his Messengers to establish the religion upright
not
This demerit has spread among the people with little knowledge trying to argue for their conception or their doctrine and trying to refute each other's proof to the extend of saying that the other has no relation to the Qur'an or Sunna, which is the worst demerit. Appropriate thing to do, was to say that they have not seen that evidence of the other Imams or that they are not as knowledgeable as them, Imams, in the understanding of the word meanings or language. Imam Shafi'y, when he entered Bagdad and visited the grave of Imam Abo-Hanifa, he left the prayer of Qunut in Salatu al-Fajr. When he was asked: why did you leave Qunut when you say it is right? He said: "I was ashamed to do it in the presence of of the Imam - he meant Abo-Hanifa in his grave - because he did not say of it? So May Allah accept those people of politeness. Sheikh Mohyeddin told a story in his book "The Maccahian revelations" that there was some people, of the county beyond the river, who would argue all year about doctrines, Shafi'y and Hanafy, so that some of them would break their fasting in Ramadan just to be able to continue arguing with their counterparts!!!
